Budeli Inc ("we", "us", or "our") provides its service to you, the user ("you" or "your"), subject to the following Terms of Service ("ToS"), which may be updated by us from time to time without notice. OUR SERVICE
We partner with various restaurants to provide you with a wide range of food options delivered directly to your building. While we market these services and handle the order and payment processes, please note that we act solely as an intermediary between you and the restaurant partners.
ORDERING AND PAYMENTS
When you place an order through our platform, you agree to pay the purchase price listed, which includes a dynamic markup by us. We collect these payments on behalf of our restaurant partners and retain a percentage of each sale along with a service fee.
DELIVERY
Deliveries are conducted by independent contractors from third-party services such as Nash, Uber, Frayt, etc. We are not responsible for the actions of these independent contractors but will assist in resolving issues where possible.
DATA USE AND PRIVACY
We collect your email, phone number, and name to process orders and improve your service experience. We use your email to send receipts and marketing communications and your phone number for order status updates and promotional texts. Your personal data is stored securely and is used exclusively to enhance service delivery and for internal business purposes. We do not engage in affiliate marketing nor do we share your personal information with third-party marketers. Any data shared with restaurant partners is strictly related to your purchases and is not used for independent marketing purposes. Our commitment to your privacy is paramount, and we adhere strictly to data protection regulations to ensure your information is safe and used responsibly.
COMPLIANCE AND ENFORCEMENT
Users must comply with all applicable laws, the Terms of Service, and our Prohibited Uses policies when using this platform. We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates these terms, including without limitation, removing the offending communication from the service and terminating the violator's service agreement.
LIMITATIONS OF LIABILITY
Budeli Inc is not liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or the inability to use our services or for the cost of procurement of substitute goods and services or resulting from any goods or services purchased or obtained or messages received or transactions entered into through the services.
INDEMNITY
You agree to indemnify and hold Budeli Inc, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the service, your connection to the service, your violation of the ToS, or your violation of any rights of another.
GENERAL PROVISIONS
These ToS constitute the entire agreement between you and Budeli Inc and govern your use of the service, superseding any prior agreements between you and Budeli Inc. The laws of the State of Virginia, without regard to its conflict of law provisions, will govern these ToS and your relationship with Budeli Inc.
